Get legal support paid for by IBCA
IBCA has approved solicitors who can represent you when making a claim. They provide independent advice which is paid for by IBCA. They all have previous experience of supporting the infected blood community and fully understand the compensation scheme's regulations.
After you've completed the make a claim form, your claim manager will offer you legal support. You can only get this support for your compensation claim. It does not cover things that might come after you make a claim, for example, paying inheritance tax.
If you already have legal support when you start your claim and the solicitor is not one of our approved panel members, IBCA will ask them to sign up to our terms and conditions so they can offer you support paid by us.
Legal support covers:
- help to confirm the information used to calculate your compensation is correct
- advice on if your compensation offer has been calculated correctly and if you should ask IBCA to review the decision
- support with an internal review, if you request one
- help to share your information with IBCA, for example medical records
Getting help with the costs of probate
If you are claiming on behalf of the estate of a deceased infected or affected person, you need to have probate. This means you have the legal right to deal with the deceased person’s property, money and possessions.
If you do not already have probate, you will need to get it. You may need to pay fees. If your compensation claim is successful, you can claim back up to £1500 of these costs from IBCA.
You cannot claim back these costs if your claim is not eligible for compensation. If you already got probate before making a compensation claim, you cannot claim back the costs.
